By using our website, you agree to be bound by Helmet City’s Terms & Conditions, as stated below.

www.HelmetCity.co.uk is an Online business only, your item cannot be returned to us in person.
We do not have a Trade/Customer counter and your purchase CANNOT be returned to any of our shops.
If you would like face to face service, please purchase directly from one of our shops.

Contract for the Supply of Products or Services
The products, prices and services illustrated on our website do not constitute a legally binding offer. No contract for the supply of products or goods will be deemed to exist between you and Helmet City unless, and until full payment has been made and the order accepted.

An acceptance email is automatically sent by Helmet City to you confirming that your order has been accepted and payment has been successfully made. This confirmation e-mail amounts to an acceptance by Helmet City of your offer to buy goods or services from Helmet City and this acceptance is effective regardless of whether or not you receive the e-mail.  Helmet City endeavour to dispatch your items within 2-5 working days.  Same day dispatch and Next day delivery are not guaranteed.

Helmet City reserves the right to withdraw from a prospective contract at any time prior to or after acceptance. This also applies after a confirmation email has been sent in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself. Under these circumstances Helmet City will notify you as soon as possible and the option to wait for stock, choose an alternative or a full refund will be offered. Helmet City can refuse to accept an order, refund an order or cancel an order at any time without notice.  Helmet City may ask for additional proof of address or other information for very high value orders.

Helmet City will accept the cancellation of an order only in writing ( email, letter or fax ) or on the return of the goods.  A Helmet used on the Road CANNOT be returned unless faulty.  For full returns terms and information please see our Returns Policy - CLICK HERE

Price and availability information is subject to change without notice.  Prices may vary between our Website and our Retail Stores. Credit cards are debited before items are shipped or before services are activated by Helmet City.

Order Information : Card Security Checks
Helmet City uses Braintree to process our Card Payments. Braintree use very stringent security checks to protect us and our customers from card fraud. On rare occasions an order is flagged as a 'Risk' by Braintree and Helmet City must investigate further. This may be due to a number of reasons, but mainly it is because the card used is from a different country to the delivery address or the delivery address given is not known to Braintree or your bank.  Also a customer must use the actual card billing address or this can also cause an issue.  We will in these cases contact you and ask for additional information to be supplied - normally proof of address for the card used and proof that the card owner works at the delivery address. To avoid any problems if you are paying from abroad, we recommend you click 'Pay using PayPal' - a PayPal account is not required.  Please do not be offended if we contact you for further information!  In some very rare occasions an order may be flagged as 'High Risk' and these will be automatically cancelled and refunded, as we cannot confirm any details you send us match the card used.  The order will have to placed again and the correct card/address details entered. Please do not be offended, we cannot accept 'High Risk' payments.  For very high value orders, Helmet City may ask for a proof of address - Water/Gas/Electricity Bill to confirm the customer lives at the address given.
Paying for your product - Exchange Rates
If paying in a Currency other than GBP (£), there may be an exchange rate difference applied by your Bank or PayPal, after you have placed the order. This is NOT applied by Helmet City and may be more than the amount shown on our website. Helmet City is NOT responsible for this difference. The Currency Rates shown on our website are automatically checked and updated regularly based on the latest Exchange Rates, but can of course be higher or lower. Try this website http://www.xe.com/

The exchange rate is for information purposes only; it does not provide binding prices for an exchange. In practice, for individual exchanges, the prices for buying and selling currencies can deviate to a greater or lesser extent from these rates – depending on the country, financial institution or bureau de change and also the method of payment. The conversion is given as an indication only.

Some Pre-Paid Credit Cards are not accepted, please contact your bank if you are having problems.

Helmet / Comms Bundle VAT Saving Offer
If you purchase a Helmet and Comms System together in order to make the comms VAT saving of 16.66%, if just the Helmet is returned the saving will be deducted from the helmet refund as it will no longer be a VAT free pruchase.

Free Gifts
FREE GIFTS : Please note, Free Gifts CANNOT be exchanged for another product, credit OR refund and NO cash alternative is offered. A Free Gift can be exchanged for a different size - if boots for example. If you decide you do not want the Free Gift after receipt, NO refund for that Free Gift will be given. The Free Gift product is the product or products illustrated, no alternative products are offered. Helmet City reserves the right to substitute any free item offered with an item of equal or greater value. If a customer wishes to return an order which qualified for a gift with purchase, the transaction can only be refunded if the gift with purchase item is also returned. We reserve the right to update or change the Terms at any time without notice to you.

Price Match
Helmet City will try and match any UK or EU price that is advertised online and the product is in stock. We do NOT guarantee to price match but will try our best. Click HERE for more Price Match information.

EU Returns / Warranty
Helmet City are NOT responsible for the returns postage from any Country outside mainland UK to get an item back under warranty.  Helmet City will cover the postage back to the customer, only if the item is found to be faulty.
Any items being returned under Warranty from outside the UK, MUST be sent back clearly marked on the paperwork and outside of the box that the item is broken and is being sent back under warranty for repair.  It must NOT have a value or there will be customs and other associated charges to pay.  Helmet City WILL NOT pay these charges, if the customer refuses to pay them, the item will be sent back, at their cost.

VAT
Helmets in the UK are Zero Rated for VAT.  All other items include 20% VAT.

Visors & Pinlock Inserts
Please ensure that the Visor or Pinlock ordered is correct for your helmet.  If the packet is opened and we cannot sell it as brand new, we will not accept it back.

Pre-Order Items
Items marked as 'Pre-Order' will be ordered with the Distributor and dispatched to the customer as soon as we receive them.  Pre-Order dates are NOT definitive and are subject to change.  Helmet City are NOT responsible for delays to Pre-Ordered items as we are dependant on our Distributors.  Helmet City does not have a Pre-Order 'customer update system', so once the order is placed we are not able to give continuous updates as to the expected delivery of the Pre-Order.  Please rest assured that as soon as the item arrives, we will send it out!

HC Points
HC Points are only available if an account is created, they are NOT available if you checkout as a Guest.  The system simply cannot assign points to an account that does not exist, so please create an Account - it is safe and secure and Helmet City will NEVER share your data with an external company.  Click HERE for more information on HC Points.

Limitation of Liability

Although Helmet City try and use the correct images for each item, sometimes mistakes can happen and the wrong image may be uploaded. It is up to the customer to confirm in advance if there are any differences between images and descriptions. Helmet City is not responsible if the image used does not match the description given. Due to manufacturer updates, screen definition differences etc, images can differ from the actual item supplied, Helmet City are not responsible for any costs if this is the case.  Some images from the manufacturer show a dark visor on the helmet, please note that ALL helmets are supplied with a Clear visor.

Helmet City is NOT responsible for checking if a Helmet is Legal for the country to which we are supplying. It is entirely the customers responsibility to ensure the Helmet they are purchasing is legal for their country. All of our Helmets are UK and European Road Legal to EC22/05.

Helmet City do not accept liability for failure to supply caused by matters beyond the company’s reasonable control including but not exclusively strikes, civil disputes, acts of God, war or other third party actions.

Helmet City is NOT responsible for exchange rate changes (at the time of placing the order or at the time of a refund), import duty or import tax to your Country. It is up to the customer to check any Duty that may be payable prior to placing the order.

Helmet City CANNOT be held responsible if an item does not fit.  Helmet City is NOT responsible for any return postage charges if an item does not fit.

The weight of Helmets shown on our website is generally for a size Medium, +/-50g and provided by the manufacturer.  Helmet City are not responsible if the weight of the actual helmet is different.

Please remember that it is the responsibility of the customer to ensure the goods are packaged for transport when returning an item. Insufficient packaging resulting in the product being damaged will be the responsibility of the customer.  The box of the product must be wrapped / protected and not covered in tape or labels.  A restocking fee may be charged for any original boxes damaged due to careless packing.  However, if we send the wrong item or there is a fault upon delivery, we will pay for the return.  Helmet City CANNOT be held responsible if an item does not fit.  Helmet City is NOT responsible for any return postage charges if an item does not fit.

Illegal Acts
It is a crime to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic fingerprints of every order placed on this website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.

Changes in Terms
Helmet City reserves the right to modify these terms at any time without prior notice. Any modification of these terms will be deemed to be effective from the date and time of posting on the Helmet City web site. Prices and special offers can change at any time, without notice and deals cannot be back-dated.

Stock
Helmet City are proud to offer tens of thousands of products in stock. Items marked as 'In Stock' are generally in stock within the Helmet City shop and warehouse network or with our Suppliers. On rare occasions stock levels may be incorrect, in which case we will try and allow the customer to choose a product of a higher value or better quality, within our cost constraints. Please note, Prices may vary between our Website and our Retail Stores so you may want to call the store in advance to confirm.

Governing Law
These terms and conditions are governed in accordance with English law and the English and Welsh courts shall have jurisdiction to resolve any disputes.
